The day after the Texas lawsuit was filed, the Trump campaign filed its own amicus brief in support with the Supreme Court. So did more than one hundred Republicans in the House.iii In a tweet, Trump called it “the case that everyone has been waiting for.”

As soon as it was filed, Carr and his team of lawyers got busy crafting their response to the Texas case. It was a forceful smackdown of the lawsuit’s fraud claims and pointedly rejected the “breathtaking remedies” (overturning a presidential election) it sought. Carr was quite proud of it. But before it was filed, he consulted with Kemp to advise him what he was preparing to do on behalf of the state of Georgia.

“Do you believe this is right?” Kemp asked him.

“Yes it is,” Carr replied.

“Well then fuck ’em,” Kemp said.

On December 11, three days after Ken Paxton filed his lawsuit, the Supreme Court briskly rejected it without granting a hearing. “Texas has not recognized a judicially cognizable interest in the manner in which another state conducts its elections,” the court said in an unsigned order.

The case “that everyone has been waiting for” was no more. Trump was furious—and his reaction was telling. “The president’s just raging about the decision and how it’s wrong and why didn’t we make more calls and just his typical anger outburst at this decision,” Cassidy Hutchinson, chief of staff Mark Meadows’s top aide, later testified about encountering Trump in the Rose Garden that day. “He had said something to the effect of, ‘I don’t want people to know we lost, Mark. This is embarrassing. Figure it out. We need to figure it out. I don’t want people to know that we lost.’”
